Allega Spender pushes to remove religious exemptions against LGBTIQ students, teachers

Independent MP Allega Spender has introduced a bill to remove federal exemptions that allow religious schools to discriminate against students, teachers and contract workers based on sexual orientation, gender identity and related grounds. The bill would also extend protections to associates of those affected. Spender said the current law sends a harmful message beyond school gates and that religious schools could keep their ethos without the exemption. The bill would still allow schools to prefer staff of their faith in hiring and in senior leadership roles.

New WA legislation to challenge discrimination in religious schools

The Western Australian government will introduce legislation to protect LGBTQIA+ students and teachers from discrimination, harassment and vilification in religious schools. Premier Roger Cook and Attorney-General Tony Buti announced the Equal Opportunity Bill 2026, which they describe as the most significant reform of the state's anti-discrimination framework in almost half a century. Under the bill, religious schools could no longer sack teachers or expel students because of their sexuality. Religious institutions would still be allowed to discriminate based on religion. Advocacy groups welcomed the announcement.

Four years after Labor’s promise, a new bill challenges religious school discrimination

Independent MP Allegra Spender has introduced a federal bill to strengthen protections for LGBTQIA+ students and staff at religious schools. The bill would remove federal exemptions that allow schools to treat people differently because of sexuality or gender identity. Schools could still prefer applicants who share their faith when hiring, and teach according to their beliefs. Labor promised similar reforms in 2022 but has not introduced them, citing the need for Coalition support. The bill has no confirmed date for debate or a vote.

Labor urged to axe faith school bill exemption

Equality advocates are urging the federal government to support an independent MP's bill that would stop religious schools discriminating against students and staff over sexuality or marital status. Independent MP Allegra Spender introduced the amendment to the House of Representatives on Monday. The bill has Greens support. Labor committed to reforming anti-discrimination laws before the 2022 election, but a report tabled in March 2024 has not yet led to changes. The attorney-general's office did not say whether Labor will back the bill.
